March 2, 2011
Jay Groob, President of American Investigative Services, Inc. was a panelist in the recent Boston Bar Association discussion on "Discovery in the Electronic Age." Other noted panelists included the Honorable E. Chouteau Levine and the Honorable Robert W. Langlois, both respected justices of the Probate and Family Court, as well as Attorney Mary Beth Sweeney, a partner with Atwood & Cherny, who specializes in Family Law.
Topics addressed included Obtaining and Admitting Electronic Data into Evidence in Court Proceedings, The Use of Social Media in Domestic Relations Proceedings, Ethical Considerations When Obtaining Electronic Information, Interpreting and Complying with Federal and State Statutes on Electronic Information, and View From The Bench on Electronic Discovery.
With much recent legislation relevant to privacy issues, including the use of GPS tracking devices, this timely and pertinent discussion provided much needed clarification on questions that continuously arise in domestic cases, such as the expectation of electronic privacy between husband and wife, and the legality of GPS tracking on the part of one spouse to monitor the whereabouts of the other.
This informative discussion, addressing the evolving issues regarding the acquisition of electronic evidence, the admissibility of same, and the expectation of marital privacy, was exceptionally well-received by all in attendance.
